1. About these Terms
Unreal Creative is operated by Unreal Productions, LLC. These Terms of Use govern permitted use of unrealcreative.com, including the Unreal Partner Studio page and related website features. “Unreal Creative,” “Unreal,” “we,” “us,” and “our” refer to that business.
Unreal Partner Studio is a service of Unreal Creative and is not a separate legal entity. The words “partner” and “Partner Studio” describe a business offering and do not, by themselves, establish a legal partnership, joint venture, employment relationship, or authority for one party to bind another.
Please read these Terms before using the website. These Terms form an agreement when you expressly accept them or otherwise assent as required by applicable law. If you do not agree, do not use features that require acceptance. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization.
2. Website information and service inquiries
This website provides information about our capabilities, experience, and services. Submitting an inquiry, requesting an estimate, or receiving general information does not, by itself, create a services agreement, reserve production time, or obligate either party to proceed with a project.
Project scope, pricing, schedules, revisions, payment, ownership, and other service terms are established in the applicable written agreement. These website Terms do not replace or amend a signed proposal, work order, services agreement, nondisclosure agreement, or other agreement between you and Unreal. In the event of a conflict concerning an engagement, the applicable agreement governs that engagement.
3. Website content and intellectual property
Website text, designs, graphics, photographs, videos, animation, audio, software, logos, and other materials are owned by Unreal or their respective rights holders and are protected by applicable intellectual property laws. Certain materials are displayed under license or with permission.
You may view the website to learn about and evaluate our services and may share links to publicly available pages. Except as permitted by law or authorized in writing by the relevant rights holder, you may not reproduce, republish, sell, distribute, alter, commercially exploit, or create derivative works from website materials. Ordinary browser caching does not violate this restriction.
You may not remove ownership notices or use Unreal’s name, branding, or website materials in a way that falsely suggests our endorsement or involvement. Except where applicable law permits otherwise, collecting or using website materials to build datasets or train artificial intelligence models requires prior written authorization from the relevant rights holder.
No rights to a client’s trademarks, copyrighted works, likenesses, or other protected materials are granted by their appearance on this website.
4. Portfolio samples and project references
Portfolio pieces and demonstrations illustrate our capabilities and experience. A project may include contributions from Unreal, clients, agencies, production partners, talent, and other professionals. A brand or project reference does not necessarily mean that Unreal performed every aspect of the work or was retained directly by the featured brand.
Client names, trademarks, testimonials, and other references do not imply an endorsement, sponsorship, or continuing relationship beyond what is expressly stated. Past results, case studies, and work samples do not guarantee particular sales, rankings, audience growth, profitability, or other outcomes.
Partner Studio confidentiality and permission for public use of project materials are addressed in our Privacy Policy and applicable written agreements. These Terms do not grant permission to publish or reuse confidential project materials contrary to those commitments.
5. Information and materials you submit
You are responsible for ensuring that you have the authority and permissions needed to submit information, files, or materials to us. Do not submit unlawful content, malicious software, or materials that infringe another party’s rights.
You retain the rights you hold in your submissions. You authorize us to receive, store, review, and use them only as reasonably necessary to handle your request, subject to our Privacy Policy and any applicable agreement. This does not give us a general right to publish your
materials, use them in our advertising, or disregard confidentiality obligations.
Do not send trade secrets, detailed confidential concepts, passwords, payment card information, patient records, or other sensitive information through a general website form. Contact us first to arrange any necessary agreement and an appropriate transfer method. Sending an inquiry does not, by itself, create a nondisclosure agreement. Existing contractual and legal confidentiality obligations remain in effect.

10. Limitation of liability
To the fullest extent permitted by applicable law, Unreal and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, arising solely from access to, use of, or inability to use this free public website.
To the fullest extent permitted by applicable law, our total aggregate liability for claims arising solely from use of this free public website will not exceed US $100. This website limit does not establish or change the liability terms for paid services, which are governed by the applicable service agreement and law.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability, statutory right, or remedy that cannot lawfully be excluded or limited. Nothing in these Terms waives nonwaivable privacy, accessibility, or consumer protection rights.
11. Claims arising from misuse
To the extent permitted by law, you agree to indemnify Unreal and its personnel against third-party claims, resulting damages, and reasonable legal fees to the extent caused by your unlawful use of this website, your infringement of another party’s rights through a submission, or your intentional interference with website security or operation. This obligation does not apply to claims to the extent caused by our own negligence or wrongful conduct.
12. Governing law and courts
These Terms are governed by the laws of New Jersey and applicable federal law, without applying conflict-of-law rules that would require another jurisdiction’s law. Where these Terms form an enforceable agreement, disputes arising from them or use of this website will be brought in state or federal courts located in New Jersey with jurisdiction over the dispute, unless applicable law gives you a right to use another court.
Nothing in this section deprives you of mandatory legal protections or limits your ability to contact a regulator or public authority.
13. Changes and interpretation
We may revise these Terms by posting an updated version and changing the date above. For material changes, we will provide appropriate notice and obtain renewed agreement where required by law. Revisions apply prospectively and do not retroactively change accrued rights or existing disputes.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms do not override obligations that cannot lawfully be limited.
